SJSU’s latest trans athlete controversy attracts statements from California Congressmen

Exclusive: R-Calif. Rep. Kevin Kiley, in Fox News Digital Report Monday, said the Mountain Conference hired the same law firm to investigate allegations of misconduct by transgender athlete Brooke Fleming, that the conference was used to defend the eligibility of athletes in court games.
Kiley is outspoken with trans athletes who compete with women and women in sports with California Governor Gavin Newsom, the Justice Department filed a lawsuit over alleged violations of the title.

“The absurdity and injustice that forces young women and girls to compete with men also present obvious safety risks,” Kelly said in a statement on Fox News’s digital numbers. “The revelation of Fox News’ digital numbers is disturbing, but regrettably: institutions willing to put student-athletes at risk of physical harm will fully react when these injuries are realized.
“Luckily, the trend has decisively opposed backward politicians and organizations who violate common sense and biological reality in an attempt to undermine the hard-hitting civil rights protections of female athletes.”
Former San Jose State women’s volleyball player Brooke Slusser is clearly the target of Fleming’s alleged plan and a Colorado State player, who spiked in his face during the Oct. 3 game. In that game, Sluce never spiked in his face. Fleming had 10 mistakes as SJSU lost directly to Colorado.
Fox News Digital previously reported that Mountain West hired Willkie Farr & Gallagher (WFG) to investigate the charges.
The Mountain District hired the company to handle the investigation the same month, the same company representative meeting to protect Fleming’s eligibility, requiring a preliminary ban to require trans athletes to disqualify women’s games and conference tournaments.
The investigation was closed three days later and Fleming was cleared of misconduct. However, as Fleming continued to finish the season, received all-meeting honors, and even led SJSU all the way to the Western Conference Championships in the West, the conference never revealed any evidence.

Law firms working to qualify SJSU Trans players also eliminate athletes who conspire to hurt teammates
Tim Heaphy, a WFG attorney who led the investigation against Fleming’s allegations, then provided assistance to the school’s legal counsel to help him conduct a federal Title IX investigation in the same situation, as shown by public records obtained by Fox News Digital. The offer was rejected.
None of WFG’s attorneys have been charged with violating any applicable rules of professional conduct.
Fox News Digital approached Wilkie Farr & Gallagher, Mountain West conference and the California State University system to respond to Kiley’s statement.
Slusser talked about the latest findings from Fox News Channel’s “U.S. Report” late last night.
“It’s obvious that once this is publicly introduced, there’s too much bias and they’re just trying to sweep this stuff under the carpet and when there’s obvious problems everywhere, there’s no need to deal with it.”
“They need to be held responsible for not thoroughly investigating the use of the same law firm because Title IX was established to protect women, and they obviously decided to protect men in this situation when they were trying to hurt female athletes in schools and they were still supporting the male athlete and were wrong throughout the place and not doing so in the whole country.
Slusser ultimately hopes no other female athlete has to deal with the same things she has gone through.

“The goal is to never have to let another female athlete experience what I did,” she said. “So the goal is to give back to young girls who have the same dreams as I did, but be able to love it all the time. ”
