Brady Kiser avoids charges after son Trigg’s drowning tragedy

The Maricopa County Attorney’s Office said there is no “possibility” for Brady.
Brady looked at Trigg alone, the couple’s son Teddy for 3 months, while Emilie’s tragic incident occurred on May 12.
“The surveillance video outside the house shows how drowning occurs and the actual timeline of the incident,” the statement said. “To convict this charge, the state must prove to a unanimous jury that the person fails to understand a substantial and unreasonable risk and fails to perceive the risk as a reasonable person will show, which is a serious standard of care.”
The MCAO added in the statement that after reviewing the evidence, it was believed that Brady was unlikely to be convicted.
“Each case submitted to the Maricopa County Attorney’s Office is evaluated using the same criteria: whether there is a ‘reasonable possibility of conviction.'” the statement continued. “After a careful review of the evidence submitted by Chandler PD, it was determined that the case did not meet the criteria. The MCAO’s review of the case involved the attorney assigned to the attorney, as well as experienced senior attorneys and county prosecutors themselves.”
Brady’s lawyer Flynn Carey Updates to the case were replied through statements shared with multiple outlets.
“We thank law enforcement and county prosecutors for conducting a thorough investigation and confirming that this was a tragic accident. Brady is still in the process of grief and thanks them for recovering together with their families when they recover together. We appreciate the compassion and support shown during this difficult time,” the statement said.

“The Chandler Police Department has completed an investigation into the tragic drowning of three-year-old Trigg Kiser. After a thorough review of the evidence, investigators recommend a 4th degree felony charge of Brady Kiser for child abuse,” the statement said. “The case has now been submitted to the Maricopa County Attorney’s Office for review.”
USA Today June reported that the arrest warrant showed Brady said Trigg went to the backyard to compete after dinner. He then noticed Trigg playing near the pool, and media reports police records showed that it was “not uncommon”.
Brady married Emilie in 2019, claiming he was soon “distracted” by Teddy, which made him forget about Trig for three to five minutes. He then claimed that he found his son floating in the pool based on the documents.
The father then said he jumped into the pool to retrieve his son and called 911.
Us Weekly confirmed through the Chandler Police Department on May 18 that Emily and Brady’s son “early” after he was evacuated from the pool on the evening of May 12.
