EU brings France to court for recycling label law

The EU is taking legal action against France’s waste classification regulations on the country.

The European Commission said in a statement that it sent France to the EU Court of Justice “incompatible” around its waste sorting labeling rules and regulations to its EU law, claiming that they prevented the free flow of products across the group.

French household items sitting under the Extended Producer Responsibility Program, such as glass bottled water or milk cartons, must carry the “Triman logo” on the packaging, along with the “Info-Tri” information, which tells consumers how to classify waste.

“The national rules for the development of requirements, such as those related to labels, will be in compliance with goods legally manufactured and sold from other member states, representing a barrier to the free flow of goods,” the Commission said.

It said such regulations “constitute a measure of the equivalent effect prohibited by Article 34 TFEU” because companies in other member states must develop unique packaging specifically for the French market.

The commission issued a “French official notice in February 2023, followed by a reasonable opinion in November 2024”, but the country is still violating EU rules.

According to the EU’s main executives, French waste classification rules can be seen as “disproportionate” and “other suitable options – fewer trade restrictions on member states – can inform consumers until EU-level coordination is achieved”.

These measures aim to reduce to 5% of packaging waste in 2030 and 15% by 2040 compared to 2018.
