Judge dismisses Alec Baldwin lawsuit, claiming malicious prosecution in fatal shooting

A New Mexico judge dismisses actor Alec Baldwin’s malicious prosecution and civil rights violations in a fatal shooting of photographers in Western films in 2021 rust.
The judge dismissed the case due to no significant action on the claim in a ruling released Wednesday, which was filed in the state district court earlier this year. Baldwin’s lawyers will have 30 days to file a motion seeking to restore the state.
Baldwin’s chief attorney Luke Nikas told the Associated Press in an email that the firing equals a non-event since his team has been waiting for the case to be prosecuted.
“We have been conducting good faith settlement discussions with the parties to the litigation and will be corrected immediately if these discussions are not resolved promptly and favorably,” he said.
The defendants include Special Attorney Kari Morrissey and Santa Fe District Attorney Mary Carmack-Altwies, as well as three investigators from the Santa Fe County Sheriff’s Office and the County Commission.
Last year, involuntary manslaughter against Baldwin was dismissed, saying police and prosecutors rejected the defense’s evidence.

Baldwin’s allegations of infringement claims include defamation, his lawyers say prosecutors and investigators target actors and co-producers in search of professional or political benefits.

Baldwin was discharged from the hospital and pointed at the pistol at Hutchins, killing Hutchins and hurting director Joel Souza. Baldwin said he pulled the hammer back but no trigger – the revolver was fired.
The actor, who recently spoke with the Associated Press at Comic-Con International in San Diego, said he couldn’t believe what happened in court that day with the trial abruptly ending, and his life was far better than in previous years.
Nevertheless, Baldwin and others rust Hutchins’ parents and sister sued in New Mexico state court. In this case, Baldwin’s testimony was postponed in May and has not been rescheduled, court records show.
