Texas bans cannabis-derived cannabinoid Vapes from taking effect

Evaporators containing THC, CBD or any other cannabinoids are now prohibited in Texas.

According to KVUE ABC, the 2024 Senate bill also bans many types of nicotine vaps, including e-cigarettes made in China, sold to children and any device that looks like a toy or smartphone case.

According to Denver-based law firm Vicente LLP, the only cannabis evaporator product allowed in the state is a low-tax oil product that complies with the Texas Compassionate Use Program (TCUP), a limited but recently expanded medical marijuana law in the state.

According to Houston’s NBC-2, Texas ban is considered one of the country’s strictest vape laws.

Retailers who capture these products will be fined up to one year and can be fined up to $4,000.

Supporters of the law say SB 2024 is designed to prevent teenagers from buying products.

Opponents say the law limits access to adults using THC to help treat medical conditions such as pain, anxiety, or post-traumatic stress disorder.

For retailers like Anthony Vasquez, co-owner of Dooby’s, South Austin, the law is causing a financial blow.

Vasquez told KVUE that products now banned account for at least a quarter of their revenue.

Now the business will “disappear overnight”, he said.

Another bill supported by Gov. Greg Abbott would ban all marijuana-derived THC products in Texas, eliminating the estimated $5.5 billion market.

However, the bill seems to be stagnant at the moment.
