X sues New York Hate Speech Disclosure Act

Social media company X’s law on hate speech has filed a lawsuit against New York State. Social Networks Global Government Affairs said to the lawsuit that claims that disclosures required by law violated First Amendment protections for freedom of speech.

The Stop Hiding Hate Bill, which will come into effect this week, will require social media companies to report on how to define and moderate content, including hate speech, misunderstanding, false information, harassment and foreign political influence.

X filed a lawsuit in 2023, involving similar state-level laws with moderate content. A panel of the Ninth Circuit Court of Appeals ruled that the lower court’s initial ruling was in favor of California. Although the law does continue, in early 2025, a between state and company led to X’s claim that the claims of the provisions were unconstitutional.
